Unsolicited Calls or Texts to Cell Phone
Do you have a new cell phone number? Are you getting unsolicited marketing texts or unwanted collection calls for strangers? Unless you gave express permission, these texts and/or calls probably violate the Telephone Consumer Protection Act of 1991 and you may be entitled to relief of $500-$1500 per text or call. This is true even if the prior owner of the cell phone number gave permission. What should you do? You should save all the offending texts and voicemails, document the identity of the sender (i.e. which vendor, collection agency, etc.) and contact the attorneys at Nationwide Consumer Rights for a free evaluation of your potential claims.
Allegedly Defective Volkswagen, Bentley and Porsche Keyless Entry, Start and Exit System
We are investigating potential class action claims against Volkswagen, Bentley and Porsche involving their Keyless entry, start and exit system called Kessy. The system has had alleged problems since 2007 and fails to work. Car owners can no longer open the door and unlock their cars simply by touching the door handle. The repair is very expensive. The problem may be caused by a defective design.
What happens: 1) I cannot lock or unlock from any door handle. 2) I’ve had similar problems to yours since I got my car so as I am having my Kessy replaced on Monday, I will let you know whether it solves the problem. 3) My car also has the same basic m.o. key fob works and if I push on the usual emblem to close the trunk it will work. But the rest of the keyless access doesn’t work. What is the proper soilder to use on this repair.—these are separate quotes from some of the forums.
Who is a potential plaintiff: Someone who has the problem with a broken Kessy system when the vehicle goes out of warranty Volkswagen, Bentley and Porsche have allegedly had this problem since 2007.
If you have a Volkswagen, Bentley and Porsche and the Keyless entry, start and exit system called Kessy is no longer working. Please contact us online or call our number 630-333-0000.
Credit or Debit Card Expiration Date Printed on Receipt
Under Fair and Accurate Credit Transactions Act (“FACTA”), a business is prohibited from printing on a customer’s receipt the card’s expiration date or more than 5 digits of the card’s number. Federal law imposes a statutory penalty of $500-1,000 for each violation of the FACTA. We have successfully brought suit against businesses for violating the FACTA and recovered statutory damages for our clients. If you have received a receipt that has your card’s expiration date or more than 5 digits of the card’s number printed on it, contact one of our attorneys today.
Unpaid or Improperly Paid Wages and Overtime
Employers today are seeking to cut payroll costs. Unfortunately, many do this by cheating employees out of rightfully earned wages. Common ways employers illegally underpay employees include:
- failing to pay time-and-a-half for hours worked over 40 in a week;
- providing “comp time” instead of paying time-and-a-half for overtime hours;
- forcing or allowing employees to work through unpaid lunch or break periods;
- altering time records to avoid paying employees for all hours worked;
- misclassifying workers as salaried employees exempt from overtime pay; or
- misclassifying employees as independent contractors when they are in fact employees.
We are always investigating unfair and illegal wage practices and have successfully recovered unpaid wages for thousands of employees. If you believe that your current or former employer did not pay you properly, you may have a claim for unpaid wages. Please contact one of our attorneys today.
Parking Ticket Privacy Violations
Many local cities in the Chicago area are violating consumer privacy rights by publishing private personal information on parking tickets. We are investigating breach of privacy rights claims arising from these violations. Send us a copy of your parking tickets and contact us if you believe your privacy rights have been violated.
Unsolicited Junk Faxes
If you have received junk faxes that you didn’t request during the past 4 years you may have a claim under Telephone Consumer Protection Act (“TCPA). The TCPA allows recipients of unsolicited junk faxes to file suit to recover fixed damages of between $500 for a violation that is a mistake up to $1500 for a willful violation.
Courts in Illinois and across the country have certified class actions for violations of the Telephone Consumer Protection Act and Consumer Fraud Act. Senders of fax advertisements should not be able to foist the cost of their advertisements on consumers.
We can review the faxes you have received to determine if you have a claim.
Unsolicited Cell Phone Text Messages
Unsolicited cell phone text messages cost consumers millions of dollars a year, and can result in additional unwanted charges on your cell phone bill. We are preparing class action lawsuits to stop these unfair advertising practices that invades your privacy and takes away your hard earned dollars. If you are a victim of unsolicited cell phone text message advertising contact one of our attorneys today.
Bank overdraft or NSF
We are currently investigating claims that some banks have allegedly created a system to unfairly increase the number of overdraft or NSF fees charged to customers by manipulating the order that checks clear a customer’s account. Under this alleged system, a bank will cause higher dollar amount checks to clear an account first and smaller dollar amount checks to clear last. By causing checks to clear in this order, the banks allegedly seek to increase the number of overdrafts. More overdrafts result in more overdraft fees collected by the bank. We are preparing class action lawsuits to stop these unfair practices that cost you hard earned money. If you believe that your bank is engaging in such a practice, contact us.
FDIC insurance Fees
We are currently investigating claims that certain banks are allegedly charging a fee to their customers which they are calling an “FDIC fee,” “FDIC assessments,” “FDIC insurance premiums,” or “FDIC insurance charges.” Labeling a fee as an “FDIC” fee may be deceptive because it creates the impression that the FDIC is requiring banks to charge this fee. The FDIC does not charge bank customers for deposit insurance or require banks to do so. If you believe that your bank is charging you a fee and calling that fee an “FDIC” fee, contact us.
